On Tuesday, Missouri Attorney General Andrew Bailey (R) filed a lawsuit against the Biden administration for failing to honor a Freedom of Information Act (FOIA) request demanding documents and communications related to President Joe Biden’s ongoing efforts to transport illegal aliens into Missouri.
Bailey, who has been an outspoken critic of the Biden administration and has engaged them in numerous lawsuits, sent a FOIA request to the Department of Homeland Security (DHS) earlier this year requesting they hand over documents about the Biden administration’s facilitation of illegal immigration into his state.
Now, Bailey is suing because the administration has failed to follow through on “its legal obligation to fulfill” a FOIA request.
In the lawsuit, the Missouri state government argued that Biden’s DHS has “deliberately” been “flying illegal aliens from the border to the interior of the country” and explained that the state “has sought to gain public records on behalf of Missouri citizens but has been met with federal interference.”
Bailey’s office also explained in a statement that the DHS has “responded with a denial of this request based on a clearly erroneous reading of the AGO’s FOIA request.”
The Republican attorney general referred to the ongoing dispute as a “game of hide and seek” that “violates the spirit and the letter of FOIA, which states that an agency shall withhold information only when the agency ‘reasonably foresees that disclosure would harm an interest protected by an exemption’ or if ‘disclosure is prohibited by law.’”
Bailey also issued a strong statement on X about the move, writing: “I’ve filed a lawsuit against the Biden administration for secretly flying illegal immigrants into Missouri, bringing drugs that are killing our children. @KamalaHarris and @JoeBiden don’t seem to care about the safety of our communities. Their stonewalling and lack of transparency are unacceptable. Missouri demands answers and accountability.”
“We will not stop until we get the truth and protect our state from this reckless disregard for law and order. This stops now,” he added.

Bailey is also one of 20 Republican attorneys general who have signed on to a separate lawsuit brought by America First Legal against the Biden administration to put a stop to the clearly illegal migrant flights into the United States.
