Donald Trump is swinging for the fences in his January 6 case.
Trump’s attorneys have filed to have the case dismissed.
Trump is citing presidential immunity as the reason the case should be dismissed.

The filing stated, “The acts alleged in the indictment lie firmly within the ‘outer perimeter’ of the president’s official responsibility.
“Therefore, they cannot form the basis of criminal charges against President Trump.”
Trump’s attorneys claimed that the charges are “breaking 234 years of precedent.”
“In doing so, the prosecution does not, and cannot, argue that President Trump’s efforts to ensure election integrity, and to advocate for the same, were outside the scope of his duties.”
Here is the problem…
It really does not matter if the argument is legitimate or not because the presiding judge in the case is Judge Chutkan, who despises Trump.
She has been waiting to get him into her courtroom and has even implied in other sentencing trials that Trump is to blame for everything.
She wants to slap Trump with a sentence that will tower over the sentence of every defendant sentenced thus far, so don’t expect this motion to be successful.
Just like most of Trump’s other cases, he is going to have to win this on appeal if he is to win it at all.
