Joe Biden is clamping down on private landowners again.
When in doubt, rewrite definitions that will allow for government overreach.
The new order by Biden will allow the EPA to regulate small waterways on private lands.
This was something that was in place when Obama was in office, but that Trump tried to end.
His efforts ended up going down in flames in the courts.
The Waterways
The Obama order was protested by private property owners, including farmers, builders, and oil producers.
They rightfully believed that the EPA regulations would dictate what they could do on their own land.
When Trump tried to pull back on the regulations, a federal judge blocked him on the premise the actions by those landowners would impact waterways their smaller waterways fed into.
Rep. Doug LaMalfa (R-CA) stated, “Rural America doesn’t need yet another rule giving the federal government more power over farming and private property.
“The federal government shouldn’t have jurisdiction to regulate puddles, ditches, seasonal creeks or culverts. All this rule does is make it more difficult to grow food or build anything.”
Senator Steve Daines (R-MT) was also upset, stating, “This is a step in the wrong direction from the Biden administration and it infringes on the rights of Montana farmers, ranchers and landowners.
“This overreaching rule threatens Montana ag and natural resources and is unacceptable. I will continue to vigorously fight to protect Montanans from out-of-touch rules handed down from D.C. bureaucrats.”
