Daniel Penny Seeks Dismissal Of Neely’s Father’s Civil Lawsuit

Daniel Penny’s attorneys are seeking the dismissal of a ludicrous civil lawsuit filed by the absent father of Jordan Neely, the mentally ill homeless man who died after Penny placed him in a chokehold on the New York City subway in order to protect his fellow passengers from Neely’s violent threats.

Penny defended himself and his fellow subway passengers from Neely, a violent, mentally ill homeless man who was threatening to kill people in a deranged rant on the New York City subway. On December 9, a jury found Penny not guilty of “recklessly” causing Neely’s death via a chokehold. He was initially charged with second-degree manslaughter for “recklessly” causing Neely’s death, as well as a lesser charge of criminally negligent homicide. After the jury was unable to agree on a verdict, the manslaughter charge was dismissed in a desperate attempt by the prosecutors to force a guilty verdict, but the jury didn’t buy it, instead choosing to effectively affirm New Yorkers’ rights to self-defense and the defense of others.

Andre Zachary — Neely’s deadbeat father who was not a part of his life — filed a civil lawsuit against Penny shortly before the jury found him not guilty in Neely’s death. In the suit, Zachery demanded “judgment awarding damages in a sum which exceeds the jurisdictional limits of all lower Courts which would otherwise have jurisdiction.”

Despite never being in Neely’s life and allowing him to live on the streets with severe mental illness, Zachery is desperately trying to profit off of his son’s death.

Meanwhile, Penny’s attorneys are fighting to get the civil lawsuit dismissed.

“All injuries or damages sustained by Plaintiff as alleged in the Verified Complaint, if any, were caused in whole or in part by the culpable conduct, negligence, carelessness, and lack of care on the part of Plaintiff, and any recovery against this Defendant must be diminished in proportion to Plaintiff’s relative wrongdoing, fault, misfeasance, malfeasance, failure to exercise due care and/or other culpable conduct,” Penny’s lawyers wrote in response to the civil suit, according to Fox News.

Penny’s attorneys, Steven Raiser and Thomas Kenniff, released a statement following his acquittal, where they vowed to continue fighting for their client against the civil lawsuit in the same manner they fought against the criminal case.

“The result was a full acquittal and a verdict that underscored New Yorkers’ belief in their right to defend themselves and their neighbors from random violence,” the attorneys told Fox News Digital in the statement. “We are committed to defending this ill-conceived civil action brought by Jordan Neely’s estranged father with the same vigor with which we defended the criminal case.”
