The NAACP received a brutal community note after trying to use Daniel Penny’s acquittal to race-bait on X.
On Monday, Marine veteran Daniel Penny was acquitted in the death of homeless man Jordan Neely, a black man with a ridiculously long rap sheet that included several assaults. Prior to his death, Neely was acting erratically and threatening his fellow passengers on the New York City subway. Penny and two other men stepped in to prevent him from hurting others, with Penny placing Neely in a chokehold and the other two men holding his arms down so he could not break free. Of course, only the white man — Penny — was charged with a crime. Neely was still alive when police arrived at the scene, but he was so filthy that officers refused to provide mouth-to-mouth resuscitation because they were concerned about diseases.
Disgraced Manhattan District Attorney Alvin Bragg charged Penny with manslaughter and criminally negligent homicide, despite the fact that Bragg is a notoriously soft-on-crime DA who downgraded 60% of all felony cases to lesser charges in 2023.
Penny was found not guilty by a jury of his peers, but that has not stopped radical leftists and race-baiters like the NAACP from using his case to sow division and push false racial narratives.
In a post on X, the NAACP shared a CNN report about Penny’s acquittal and falsely claimed: “The acquittal of Daniel Penny in the death of Jordan Neely has effectively given license for vigilante justice to be waged on the Black community without consequence. It’s a painful reminder of the inequities in our justice system. Jordan deserved compassion. Instead, he was met with violence. We stand with his family in calling for accountability.”
X users were quick to flock to Community Notes, a feature that allows X users to add and vote on corrections/context to posts, to call out the lies in the NAACP’s post.
“Daniel Penny did not act alone in defending himself and others from Neely,” the note read. “A black man can be clearly seen assisting Penny to subdue Neely. A black woman testified in defense of Penny. There is no evidence that Penny was motivated by race.”

The Community Note also included a link to a video showing proof that at least one black man had helped Penny restrain Neely.
“It should be noted that another black man attempted to restrain Jordan Neely,” the video’s caption read. “This event was not racial nor was the verdict. If you wanted to show compassion to Mr. Neely it should’ve [come] during the 100+ prior times he was arrested. He was a danger to his community. Just a fact.”

Others in the comment section also highlighted the fact that a very similar case did not face the same prosecution — pointing out that Jordan Williams, a 20-year-old black man, had stabbed a homeless man to death on the subway because he was also threatening his fellow passengers. However, Williams had all of his charges dropped.
