Joe Biden Fights Federal Judge Over Border

The United States Border has become a wide open door under the Biden administration and Old Joe wants to keep it that way. Biden fights back against a judge’s order that blocked the release of illegal immigrants into the US. The Biden administration said it will appeal a federal judge’s order. The leftwing administration claims that releasing migrants into the US without court dates is necessary. They reason that Customs and Border Protection (CBP) facilities are over-capacity.

An issue that would have been mitigated if Trump era Title 42 had not ended.

DOJ attorneys asked the U.S. District Court in the Northern District of Florida for an emergency stay on Judge T. Kent Wetherell II’s two-week restraining order on the Biden administration policy. The DOJ notified the court of the administration’s plan to appeal to the 11th Circuit.

In response to a lawsuit in the Sunshine State, Wetherell blocked the administration’s “parole with conditions” policy. The order came as hundreds of thousands of migrants surge to the U.S. border as the Title 42 public health order comes to an end. Title 42 allowed for the quick removal of migrants due to the COVID-19 pandemic. Agents encountered over 10,000 migrants per day on multiple days. On Friday, May 12th, there were more than 25,000 in custody.

A Border Patrol memo released described the release policy. The memo said that migrants can be allowed into the country on parole, which is a process usually reserved for “urgent humanitarian reasons or significant public benefit,” if Border Patrol faces overcrowding. The memo calls the practice “parole with conditions” as migrants are required to make an appointment with Immigration and Customs Enforcement (ICE) or request a Notice to Appear by mail, appointments that are rarely if ever made.

Under the policy of parole release, migrants are rapidly released into the country. At the time of their release, they do not get an alien registration number and do not receive a court date.
