State Supreme Court Deals Heavy Blow to Democrat Leader

A state Supreme Court has dealt a heavy blow to an authoritarian Democrat governor who has consistently violated the Constitution.

The Issue

The Board of State Canvassers in Michigan has refused to certify the signatures on a petition from Unlock Michigan, a group trying to force the repeal of the state law that Democrat Governor Gretchen Whitmer used to issue emergency orders at the start of the COVID pandemic last year.

In a legal complaint, Unlock Michigan argued: “Instead of performing its ministerial duty to certify the Unlock Michigan petition, the Board shirked its duty and instead discussed investigating Unlock Michigan’s petition-gathering methods and promulgating certain rules.”

The Ruling

The Michigan Supreme Court has ruled that the Board of State Canvassers have a “legal duty” to certify the signatures on Unlock Michigan’s petition.

The GOP-backed group submitted more than 500,000 signatures on their petition last fall, and the signatures were even deemed valid by corrupt Democrat Secretary of State Jocelyn Benson.

The state’s attorney general, Dana Nessel, initiated a probe against the group, finding that its tactics were “sleazy,” but not illegal. Yet, the Board of State Canvassers still refused to certify the petition, as the bipartisan board’s vote deadlocked 2-2 in its certification vote in April. The board also deadlocked on a vote to further investigate the collection of signatures.

The court ruled that the canvassers have no authority to investigate the matter any further.

“An investigation that goes beyond the four corners of the petition itself (i.e., the validity of the signatures or registration status of the electors) into the circumstances by which the signatures were obtained… is clearly beyond the scope of the board’s authority,” the court ruled.

“The Board thus has a clear legal duty to certify the petition,” the ruling stated, with the court also noting that the Bureau of Elections had analyzed the signatures using random sampling and had estimated that Unlock Michigan had submitted at least 460,000 valid signatures, when only 340,000 were needed.

“No governor in the future will be able to rule by decree without end the way Gov. Whitmer has,” said Unlock Michigan spokesperson Fred Wszolek.

Governor Whitmer used the law to issue authoritarian emergency orders that effectively destroyed the state’s economy and infringed on the constitutional rights of its citizens, until October 2, 2020, 10 days after Unlock Michigan submitted its signatures, when the Michigan Supreme Court dubbed the law unconstitutional. The corrupt Democrat governor then found a loophole, and continued using her authoritarian powers via a different law.

DJHJ Media makes the best point: “Is there anything in Michigan that is not corrupt? That is a rhetorical question and the answer is no.”

Once the petition is officially certified, the Michigan legislature will have the opportunity to vote to end Whitmer’s emergency powers by repealing the 1945 Emergency Powers of Governor Act. Whitmer will have no say in this matter, and cannot veto the legislation. Then the state can finally open back up again.
